Booking Fee (Deposit)

The Booking Fee serves to reserve the time and services of the Videographers for the event. It is non-refundable and non-transferable in the event of cancellation, as it represents the agreed compensation for the Videographer's loss due to cancellation. Should the event need to be postponed, the deposit will be retained if Wyatt Media can reschedule for the new date and time, however may be subject to a further deposit.

Payments

Following payment of the booking fee, the remaining balance must be settled four weeks prior to the event date. Late payments will incur a 5% charge, added to the final balance. Full payment is necessary for the delivery of films. Payments ideally should be processed via our PayPal account, a bank transfer can be discussed and accepted if the client(s) are not a PayPal user.

Display

Unless otherwise specified by the client, the Videographer may showcase any footage from this contract in their studio, portfolio, exhibitions, advertising, competitions or online platforms.

Editing

Wyatt Media reserves the right to retouch, digitally manipulate, and finish the footage at our discretion. Any additional retouching, digital manipulation, or finishing requested by the client(s) may be subject to extra charges, at the discretion of Wyatt Media. After reviewing the initial draft and submitting change requests within a two-week timeframe, clients will be invited to preview the final film before delivery, allowing them to make final decisions regarding the content. Failure to provide change requests within two weeks from the date sent gives Wyatt Media the discretion to decline requests for changes and proceed with delivering the film as is.

Equipment

Although we utilise high-quality, well maintained equipment, we cannot accept responsibility for occurrences such as radio signal losses, battery failures, equipment malfunctions, or material defects that are beyond our control. In the rare event of a complete video failure, our liabilities are restricted to refunding all payments made by the client(s).

Copyright

All video footage, whether stored digitally or otherwise, along with any related computer programs, including source or object code, computer files, or printed documentation, is safeguarded under the Copyright and Design Act of 1988. Any reproduction or distribution of images created under this contract without written permission from the Videographer is prohibited by law. Wyatt Media abstains from incorporating commercial music into our films; instead, we utilise royalty free assets to facilitate online display for our clients.

License

The selected videographer will have the authority to exercise artistic discretion concerning the filmed footage and chosen locations. Their judgment regarding locations, poses, and shot quantity will be considered final. However, unforeseen weather conditions and the cooperation of subjects may occasionally prevent the capture of all requested footage.

Attendance

Wyatt Media functions as a team of videographers, carefully chosen by Matt Wyatt, the creative director. In the rare event that the designated videographer is unable to attend due to unforeseen circumstances, Wyatt Media reserves the right to send a replacement of equal skill level. This replacement will meet the high standards set by Wyatt Media.

In the unlikely scenario of a total video failure or contract cancellation by either party, liability is capped at the total contract value. Neither party will be responsible for indirect or consequential losses.

Regardless of event timings, the Wyatt Media team operates until 9pm, unless agreed upon otherwise with Matt Wyatt. Overtime will be charged at £150 per hour, with prior notice and billing before the footage is released.

Abuse

Wyatt Media has a zero-tolerance policy for any form of abuse directed towards its staff, including physical, verbal, or threatening actions as determined by the staff member. Should such behaviour occur, the Wyatt Media team member(s) retains the right to leave the event, regardless of whether filming is complete. The client will bear full liability, and Wyatt Media will not provide any full or partial refund.

Meals

A hot meal provided to the videographer(s) is a nice gesture for our services, although the client is not obligated to provide. In the event where a hot meal is provided, it is important that this is served at the same time as food is served to guests. Meals provided at any other time may impact what footage we are able to capture.

Video Footage/Digital Files

Video footage/digital files are the property of Wyatt Media. While the Videographer is not solely accountable for storing and maintaining these assets, they are responsible for ensuring the footage and files are preserved and accessible to the client for a minimum of 12 months from the event date.

Website Display

Video footage from the event may be showcased on the Wyatt Media website, unless explicitly . While Wyatt Media endeavours to safeguard these video clips against malicious activities, it cannot be held responsible or liable for any such actions perpetrated by individuals other than Wyatt Media employees.

Expenses

All expenses are inclusive of displayed price, unless exceptional circumstances are met, for example, unsafe travel following the event, excessive parking tariffs. Case by case will be discussed and agreed upon during consultation or at the event.

Delivery

All of our films are unique, so delivery times may vary, we aim to deliver your film as soon as possible. Depending on the volume of work, typical delivery is four weeks following the event. High wedding season delivery can take up to three months. We prioritise quality and prefer not to rush the process to ensure the best possible outcome. Wyatt Media will keep you updated on our current delivery schedules.

Our films are distributed via the online platform Google Drive. You have the flexibility to share this link with friends and family for convenient viewing. Additionally, you have the option to download and save your films to your computer, USB, or DVD for personal preservation.

Cancellation

The client may cancel the contract at any time via written notice to Wyatt Media.

Cancellation charges will be applied and are as followed:

  1. More than ninety days prior to event date = deposit only

  2. Ninety days to thirty days prior to event date = deposit plus half the remaining balance

  3. Less than thirty days prior to event date = Full balance is owed

Complaints

The majority of complaints can be swiftly resolved and should be initially brought to the attention of Wyatt Media by the client within 7 days of receiving their film.

On completion of the online Wyatt Media booking form you are agreeing to the terms set out. Any questions or concerns may be discussed with Laura and/or Matt Wyatt of Wyatt Media prior to securing your booking. No amendments shall be made to the current contract without prior agreement from both parties.
